TERMS AND CONDITIONS OF TOSTADORA CLUB
EXPRESS ACCEPTANCE
By entering a discount code, ticking the corresponding box and pressing the acceptance button, the Member declares that they have read and fully understood these Terms and consents to receiving the commercial communications described herein and to enjoying the discounts and promotions offered. Revocation of such consent shall not affect any processing carried out beforehand.
PURPOSE AND SCOPE
These terms of use (hereinafter, the “Terms”) govern access to and use of the advantages, discounts and other benefits (hereinafter, “Tostadora Club”) available on this website, owned by Nextalia Ventures, S.L. (hereinafter, the “Owner”), with registered office at C. d’Eduard Maristany 352, 08918 Badalona, Barcelona, Spain. It is entered in the Mercantile Registry of Barcelona under tax ID (CIF) B-63771349; full details appear in the General Terms of Use (hereinafter, the “General Terms”) available on this same website.
By reading and accepting these Terms, the user (hereinafter, the “Member”) confirms their willingness to be bound by them and agrees to receive commercial communications and access any discounts and advantages offered.
REGISTRATION
To enjoy the discounts offered by the Owner, the user must obtain Member status and complete the registration process, providing truthful, accurate and up-to-date data. Once registered, the Member will receive personal, non-transferable login credentials and undertakes to keep them under their sole responsibility and not to disclose them to third parties. Failure to provide truthful information or to safeguard the credentials with due care may result in suspension or termination of access.
SENDING OF ADVERTISING
Acceptance of these Terms and enjoyment of promotions expressly entails receiving commercial or advertising communications from the Owner regarding its own products and services that may be of interest to the Member. Such communications will be sent by e-mail, SMS, instant messaging or any other enabled channel.
The Member may withdraw their consent at any time through the unsubscribe mechanisms provided in each communication or by writing to [email protected].
DISCOUNTS AND PROMOTIONS
The Owner offers exclusive favourable conditions to Members in the form of discounts, coupons or special promotions, either temporary or ongoing, depending on the products or services available. These advantages are strictly personal, non-transferable and must be used in accordance with the specific terms of each promotion. The Owner may modify the discounts or advantages at any time without prior notice, informing the Member accordingly.
MEMBER OBLIGATIONS
The Member undertakes to:
• Use Tostadora Club in accordance with applicable law and these Terms.
• Provide truthful and accurate information and update their data when necessary.
• Refrain from disseminating unlawful, harmful or third-party-infringing content, and from engaging in conduct that disrupts the normal functioning of the website.
• Respect the Owner’s content-moderation policies and complaint procedures, where applicable.
• Use the benefits of Tostadora Club loyally, avoiding abuse or fraudulent use of the advantages offered.
Breach of these obligations may result in the Member’s removal, the cancellation of their account and/or the adoption of appropriate legal measures.
PERSONAL DATA PROTECTION
Personal data collected through registration and use of the website will be processed in accordance with Regulation (EU) 2016/679 (GDPR).
The Owner, acting as Data Controller, will use the data to:
• Manage the relationship with the Member and enable access to the Client Area;
• Send commercial and advertising communications based on the consent provided;
• Apply the offered discounts or benefits and handle any claims or incidents relating to Tostadora Club.
Processing is governed by the Privacy Policy available on this website, which details the categories of data processed, legal bases, recipients, any international transfers and retention periods. The Member may exercise their rights of access, rectification, erasure, objection, restriction and portability via the contact form or by e-mailing [email protected]. Consent to receive advertising may be withdrawn at any time without affecting the lawfulness of processing prior to withdrawal.
LIMITATIONS OF LIABILITY
The Owner shall not be liable for errors or omissions in the information provided, nor for any lack of availability of Tostadora Club benefits where such unavailability is due to causes beyond its control, including technical incidents, maintenance tasks or force majeure. Nor shall it be liable for any damages of whatsoever nature arising from use of the Members’ Area where such damages are not attributable to it. Access may be interrupted temporarily or permanently for security reasons or by legal mandate, without giving rise to any right to compensation.
AMENDMENTS TO THE TERMS
The Owner reserves the right to amend these Terms for justified reasons and undertakes to inform the Member of any changes that significantly affect their rights. Continued use of the benefits of Tostadora Club after notification of such changes shall constitute acceptance of the new Terms. If the Member disagrees, they may request cancellation at any time.
COMPLAINT AND CONTENT-MODERATION PROCEDURES
Should Tostadora Club permit the publication of comments or other content by Members, the Owner will have an internal procedure for notifying and potentially removing content deemed unlawful or in breach of these Terms. The Member may lodge complaints or notifications via the contact form or by e-mail to [email protected], clearly stating the nature of the claim. The Owner will address the matter with due diligence and inform the Member of its decision and reasoning.
DURATION AND TERMINATION
These Terms shall remain in force indefinitely while the Member’s registration is active, without prejudice to the Owner’s right to suspend or terminate access for breach of these Terms or by order of a competent authority. The Member may cancel their membership at any time, which will cease the receipt of commercial communications and result in the loss of associated discounts and promotions.
APPLICABLE LAW AND JURISDICTION
These Terms are governed by Spanish law. The parties submit to the courts and tribunals determined in accordance with the law. Where the Member is deemed a consumer, the most protective jurisdictional rules shall apply.
